BIM.Supply — Terms of Service

Effective Date: March 23, 2026

1. Acceptance of Terms

By accessing or using any services provided by BIM.Supply ("we," "us," or "our"), you ("the Client" or "you") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

BIM.Supply provides Building Information Modeling (BIM) supply and related professional services. The specific scope, deliverables, and timelines for your engagement will be outlined in your service agreement, proposal, or order confirmation.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3. Account Responsibilities

You are responsible for:

Providing accurate and up-to-date account information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying us immediately at contact@bim.supply if you suspect unauthorized access

BIM.Supply is not liable for losses resulting from unauthorized account access caused by your failure to safeguard your credentials.

4. Payment & Billing

Fees for services are outlined in your service agreement or at the time of purchase
Payment is due as specified in your order or invoice
Late payments may result in suspension of services
All fees are in Canadian Dollars (CAD) unless otherwise stated
Applicable taxes will be added where required by law

5. Satisfaction Guarantee & Refunds

BIM.Supply offers a 100% Satisfaction Guarantee for 14 days from the date of purchase or service activation. Full details are outlined in our Refund & Return Policy.

6. Acceptable Use

You agree not to use our services to:

Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Transmit harmful, fraudulent, or misleading information
Interfere with or disrupt our systems or infrastructure
Attempt to gain unauthorized access to any part of our platform

Violation of this section may result in immediate termination of your account without a refund.

7. Intellectual Property

All content, tools, processes, and materials provided by BIM.Supply remain the intellectual property of BIM.Supply unless otherwise agreed in writing. Nothing in these Terms grants you ownership of our proprietary materials.

Work product delivered to you as part of a completed service engagement is yours upon full payment, unless otherwise specified in your service agreement.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of your service agreement.

9. Limitation of Liability

To the fullest extent permitted by law, BIM.Supply shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of our services. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days prior to the event giving rise to the claim.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available." BIM.Supply makes no warranties, express or implied, beyond what is stated in these Terms or your service agreement, including no implied warranties of fitness for a particular purpose.

11. Termination

Either party may terminate a service engagement in accordance with the terms of your service agreement. BIM.Supply reserves the right to suspend or terminate your account immediately for violations of these Terms, with or without prior notice.

Upon termination, your right to access the services ceases. Provisions that by their nature should survive termination (including confidentiality, IP ownership, and limitation of liability) will remain in effect.

12. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through your account portal. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
